ICML VI held in Xiamen

The Sixth International Conference on Maritime Law (ICML VI) was held in Xiamen from October 26 to 28, 2005. The conference was hosted by the China Maritime Law Association and supported by China's Supreme People's Court, the All China Lawyers' Association, and PICC.
Topics discussed included financial leasing for ships, maritime safety, bills of lading, oil pollution liability under Chinese law, transportation law, logistics, NVOCs, maritime arbitration and litigation, marine insurance, international hull clauses, and the drafting of PRC antitrust law. The conference was well attended by delegates from China and aboard. All major shipping law firms in China and Hong Kong sent their representatives including Ince & Co, Clyde & Co, Richards Butler, Holman Fenwick & Willan, Healy & Baillie, Wang Jing & Co., Huang & Yang, Haitong Law Firm and Heng Xin Law Office. The papers that attracted most attention were those related to oil pollution law and practice in China. Many questions were raised. The speakers' views differed on issues such as whether or not the definition of "pollution damage" under the CLC Convention includes mid-term and long-term damage to the environment and maritime resources and whether or not the owner of a non-tanker vessel which is involved in a collision with a tanker that spills oil should also be liable for the oil pollution damage and if so, whether such liability be joint or several. No conclusion was reached but Justice Liu Xinyu of the Supreme Court of the PRC indicated that the Supreme Court would issue general guidelines regarding the interpretation of the various legislation on the law of oil pollution in China.
