Certification ProcedureWill have effect in the Russian Federation on 24 May 2009. Regulations implementing the Convention will be published in late April, although the Russian delegation to the IOPC Fund informed the Secretariat that the same procedure that applies for CLC will apply for Bunkers, namely that the designated harbour masters in Russian ports for CLC will issue the Bunkers Convention certificates.
Regulations on the issue of the Insurance Certificates or other Financial Security under the Civil Liability Convention for Bunker Oil Pollution Damage
I. General Provisions- Regulations on Issue of Insurance Certificates 0r other Financial Security under the Civil Liability Convention for Bunker Oil Pollution Damage (hereinafter "the Regulations") were worked out in order to implement the obligations of the Russian Federation arising from the International Convention on Civil Liability for Oil Pollution Damage as of 2001 (hereinafter "the 2001 Convention"), Federal law dated December 03, 2008 No 230-ФЗ «On accession of the Russian Federation to the International Convention on Civil Liability for Oil Pollution Damage as of 2001» , as well as in accordance with Paragraph 3 of the Item 1 and Item 5.2.55 of the Statute Concerning Department of Transportation of the Russian Federation, approved by the Russian Federation Government Decree dated July 30, 2004 No 395 .
- The present Regulations determines the procedure for issue of the certificates seaports captains to the vessels sailing under the State flag of the Russian Federation, as well as to the vessels registered in states which are not parties to the 2001 Convention.
- Each vessel with the tonnage more than 1000 units entering or leaving a port of the Russian Federation or arriving at or leaving an offshore facility in the territory of the Russian Federation should have a certificate confirming insurance or other financial security in the form of guarantee of a bank or other credit organization (hereinafter "the Financial Security") to cover the shipowner's liability for bunker oil pollution damage (hereinafter "the Certificate").
- The certificate is issued to a vessel sailing under the State flag of the Russian Federation which is not in ownership of the Russian Federation or constituent entity of the Russian Federation on the basis of the application of shipowner or its authorised representative.
- The application for the Certificate should be submitted to a seaport captain.
- The following information should be specified in the application for the Certificate
- vessel name and type, its distinctive number or calling signal;
- vessel nationality (vessel's flag);
- vessel's port of registration;
- vessel's registered number under State Register of Ships, bareboat charter register, Russian international register of ships;
- vessel's IMO number;
- amount of bunker oil, including lubricants used or for use on a vessel or in vessel's power units and any such fuel remains which a vessel may carry;
- shipowner's full name, place of location, mailing and other contact information;
- authorised shipowner representative's full name, place of location, mailing and other contact information if the application is filed by such representative;
- type and term of the financial security;
- insurer's full name, place of location, mailing and other contact information or other organisation provided financial security.
- The duly certified copy of a document showing that there is financial security should be attached to the application.
- The seaport captain with responsibility for issuing the Certificate checks the application against the requirements of Paragraph 6 of these Regulations and existence of duly certified copy of a document showing that there is financial security.
- The seaport captain issues the Certificate upon examination of the information specified in application for Certificate including information regarding vessel under State Register of Ships, bareboat charter register, Russian international register of ships.
- The seaport captain issues the Certificate within 7 days of receipt of the application for the Certificate.
- The Certificate issued by a seaport captain should contain information specified in Item 6 of the present Regulations as well as the period of the Certificate's validity which may not exceed the term of the Financial Security.
- The Certificate for the vessel sailing under the State flag of the Russian Federation which is not in ownership of the Russian Federation or constituent entity of the Russian Federation is issued by the seaport captain in accordance with the template specified in Appendix 1.
- The Certificate is issued in Russian and should contain a translation into English.
- The Certificate is signed by the seaport captain and stamped with his seal.
- A copy of the Certificate issued by the seaport captain should be kept by him.
- The reasons for refusal to issue the Certificate are:
- non-compliance of the application for the Certificate with the requirements of Paragraph 6 of these Regulations;
- discrepancy of information specified in application for the Certificate with information under State Register of Ships, bareboat charter register, Russian international register of ships;
- non-presentation of a duly certified copy of a document showing that there is financial security;
- filing of application for the Certificate by an unauthorized person.
- The certificate is issued to a vessel sailing under the State flag of the Russian Federation which is in ownership of the Russian Federation or constituent entity of the Russian Federation on the basis of the application of organisation authorized to exercise shipowner's rights in the name of the Russian Federation or constituent entity of the Russian Federation or its authorised representative.
- The application for the Certificate should be submitted to a seaport captain.
- The following information should be specified in an application for the Certificate:
- vessel name and type, its distinctive number or calling signal;
- vessel nationality (vessel's flag);
- vessel's port of registration;
- vessel's registered number under State Register of Ships, bareboat charter register, Russian international register of ships;
- IMO number;
- amount of bunker oil, including lubricants used or for use on a vessel or in vessel's power units and any such fuel remains which a vessel may carry;
- shipowner's full name, place of location, mailing and other contact information;
- full name, place of location, mailing and other contact information of organisation authorized to exercise shipowner's rights in the name of the Russian Federation or constituent entity of the Russian Federation.
- The Certificate to a vessel which is in ownership of the Russian Federation or constituent entity of the Russian Federation and sailing under the State flag of the Russian Federation is issued by the seaport captain within 7 days of receipt of the application for Certificate in accordance with the template specified in Appendix 2.
- The seaport captain with responsibility for issuing the Certificate checks application for Certificate against the requirements of Paragraph 19 of these Regulations.
- The seaport captain issues the Certificate upon examination of the information specified in application for Certificate including information regarding the vessel under the State Register of Ships, bareboat charter register, Russian international register of ships
- The Certificate issued by the seaport captain should contain information specified in Paragraph 19 of these Regulations as well as the period of the Certificate's validity.
- The Certificate is issued in Russian and should contain a translation into English.
- A copy of the Certificate issued by the seaport captain should be kept by him.
- The Certificate is signed by a seaport captain. A seaport captain's signature is stamped with his seal.
- The reasons for refusal to issue the Certificate are
- non-compliance of the application for the Certificate with the requirements of Paragraph 19 of these Regulations;
- discrepancy of information specified in application for the Certificate with information under State Register of Ships, bareboat charter register, Russian international register of ships;
- filing of application for the Certificate by an unauthorised person.
The certificate is issued to a vessel sailing under the flag of a state which is not party to the 2001 Convention on the basis of the application of the shipowner or it's authorised representative.The following information should be specified in an application for the Certificate:
- vessel name and type, its distinctive number or calling signal;
- vessel nationality (vessel's flag);
- vessel's port of registration;
- IMO number;
- shipowner's full name, place of location, mailing and other contact information;
- authorised shipowner representative's full name, place of location, mailing and other contact information if the application is filed by such representative;
- type and term of the Financial Security;
- insurer's full name, place of location, mailing and other contact information or other organization provided financial security.
- The duly certified copy of a document showing that there is financial security should be attached to the application.
- The documents provided should be made in Russian or contain a duly certified translation into Russian.
- The seaport captain issues the Certificate within 14 days of receipt of the application for the Certificate and a duly certified copy of a document showing that there is financial security should be attached to the application.
- The seaport captain with responsibility for issuing the Certificate checks the application for the Certificate against the requirements of Paragraph 29 of these Regulations and the existence of duly certified copy of a document showing that there is financial security should be attached to the application.
- The seaport captain issues the Certificate upon examination of information specified in the application for the Certificate.
- The Certificate issued by the seaport captain should contain the information specified in Paragraph 29 of these Regulations as well as the period of the Certificate's validity which may not exceed the term of the Financial Security.
- The Certificate for a vessel sailing under the flag of a state which is not party to the 2001 Convention is issued by the seaport captain in accordance with the template specified in Appendix I.
- The Certificate is issued in Russian and should contain a translation into English.
- The Certificate is signed by the seaport captain. The seaport captain's signature is stamped with his seal.
- A copy of the Certificate issued by the seaport captain should be kept by him.
- The reasons for refusal to issue the Certificate are:
- non-compliance of the application for the Certificate with the requirements of Paragraph 29 of the present Regulations;
- uncertainty of the information specified in application for the Certificate;
- non-presentation of a duly certified copy of a document showing that there is financial security;
- filing of the application for the Certificate by an unauthorised person.

The United Arab Emirates has acceded the International Convention On Civil Liability for Bunker Oil Pollution Damage, 2001.
On 17 March 2022 the UK Government published a General Trade Licence in part to clarify earlier amendments to the UK Russia (Sanctions) (EU Exit) Regulations (the “Regulation”). Specifically, the licence addresses the issue as to whether it is lawful under the Regulation for insurers and reinsurers domiciled or operating from the United Kingdom to provide insurance for vessels calling at Russian ports or transiting Russian territorial waters.
