The UK Club has received the attached circular from our local correspondents, Huatai Insurance Agency & Consultant Service Ltd, regarding the prohibition of discharging waste water generated by open-loop exhaust gas cleaning systems (Scrubbers) within Emission Control Areas in China.
Reference is made to the most recent update from the Club, giving notification of the new tariff for pollution fines in Turkish waters. Particular attention should be given to the fact that these administrative fines imposed by the Environmental Protection Agency, pursuant to the Turkish Environmental Code (EC), are drastically increased in comparison to previous tariffs.

We want to bring to the Member's attention an important clarification of an operators duty, following on from the decision in the case of Jennings - v TUI Cruises, in respect of which we posted a legal update on 7th February 2018. That decision was cemented by a recent successful application for summary judgment, in the case of Dr Sucheta Mahapatra - v - TUI UK Ltd.

The Club has recently handled two separate incidents in Algeria where crew members taking cash to the Master of the ship have had the cash confiscated by the Algerian Customs, as well as a fine imposed for twice the amount of the cash value.
